Terms of Service

1. Scope

These Terms of Service ("Terms") govern the use of the Riservato platform operated by Riservato ("Riservato", "we", "us") by restaurant businesses ("Customers"). By creating an account you accept these Terms.

2. The service

Riservato is a software-as-a-service reservation and front-of-house platform: online booking, a visual floor plan, guest CRM, analytics, automated guest communications and an embeddable booking widget. We provide the service on a best-effort basis and may improve or change features over time.

3. Accounts

You must provide accurate registration details and keep your login credentials confidential. You are responsible for all activity under your account and for your staff's use of it.

4. Subscriptions, prices & billing

Paid plans are billed in advance, monthly or yearly, via our payment processor (Stripe). Prices are shown in CHF and exclude VAT unless stated otherwise. A free trial may be offered; at its end a paid plan is required to keep full access.

Plan changes mid-cycle are prorated — on an upgrade you pay only the difference; the renewal date is unchanged. Subscriptions renew automatically until cancelled.

5. Cancellation

You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period and you retain access until then. Fees already paid are non-refundable except where required by law.

6. Guest bookings

Diners book, modify and cancel tables free of charge. The reservation contract for a table is between the diner and the restaurant; Riservato provides the booking technology only and is not a party to it.

7. Acceptable use

You may not misuse the service, attempt to disrupt or gain unauthorised access to it, use it unlawfully, or send unsolicited or unlawful communications to guests. You are responsible for the lawfulness of the content and guest data you process.

8. Availability & warranty

We aim for high availability but do not warrant that the service will be uninterrupted or error-free. The service is provided "as is". Maintenance, updates and circumstances beyond our control may cause temporary downtime.

9. Liability

To the extent permitted by law, our liability is limited to direct damage caused by intent or gross negligence and is capped at the fees you paid in the twelve months preceding the event. We are not liable for indirect or consequential damage, lost profits, or lost data or bookings. Mandatory statutory liability remains unaffected.

10. Data protection

We process personal data as described in our Privacy Policy. Where we process guest data on your behalf, you are the controller and we act as your processor.

11. Changes to these Terms

We may amend these Terms; we will announce material changes in advance. Continued use after a change constitutes acceptance.

12. Governing law & jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Rudolfstetten, Switzerland, subject to any mandatory legal venue.
